2. Description of Service

UpgradeMe is an AI-powered photo transformation service that allows users to transform their photos into different styles (professional, dating, charming, creative). The Service uses artificial intelligence to generate modified versions of uploaded photos.

3. User Accounts

• You must be at least 18 years old to use this Service
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• You must provide accurate and complete information

4. Credits and Payments

• Credits are purchased as one-time payments
• Credits expire 7 days after purchase
• Purchasing additional credits resets the expiry for all credits
• Credits are non-refundable except as described in our refund policy
• Prices are in Euros (EUR) and include applicable taxes

5. Acceptable Use

You agree NOT to:

• Upload photos of people without their consent
• Upload photos of minors
• Use the Service to create illegal, harmful, or misleading content
• Use the Service for harassment, defamation, or fraud
• Attempt to circumvent usage limits or security measures
• Resell or redistribute generated content commercially without permission
• Use automated tools to access the Service

6. Photo Rights and Ownership

• You retain ownership of photos you upload
• You grant us a limited license to process your photos for the Service
• You own the generated images for personal and commercial use
• You are responsible for ensuring you have rights to uploaded photos

7. Quality and Results

• AI-generated results may vary in quality
• Failed generations (due to AI errors) do not consume credits
• We do not guarantee specific results or outcomes
• Results should not be used for official identification documents

8. Refund Policy

Refund requests are evaluated on a case-by-case basis. We may offer refunds if:

• There are persistent technical issues preventing use of the Service
• Generated images are consistently unusable due to AI errors

Refunds are not provided for subjective dissatisfaction with results or expired credits.

9. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the Service

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason. You may delete your account at any time through your account settings.

12. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
